Personal Information Protection Notice issued in accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”).

Guud Mobility (Pty) Ltd (“Guud”) is committed to protecting the privacy and security of your personal information. This Privacy Policy outlines how we collect, use, disclose, and safeguard your information when you use our services.

Guud provides a secure mobile telehealth platform allowing you, the User, access to healthcare providers to inter alia, perform primary healthcare and optometry services (the “Services”). We do this through our Guud Platform, and other electronic means such as video conferencing, chat, phone, and surveys.

Guud is not a medical group. Any healthcare consultations undertaken in the provision of the services are provided by healthcare providers, operating as sub-contractors of Guud.

This Privacy Policy (our “Privacy Policy”) describes the types of information we may collect from you or that you may provide when you use the Guud Platform, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Guud Platform and make use of the services. By accessing or using the Guud Platform, you agree to this Privacy Policy.

This Privacy Policy may change from time to time. We will notify you by email to the email address specified on registration of any changes that we make to the privacy policy. Your continued use of the Guud Platform and the services after we make changes is deemed to be acceptance of those changes.

What information do we collect? 

Guud collects different types of personal information about you, including:

  • information that may directly identify you, such as name, address, e-mail address or telephone numbers;

(collectively referred to as Personal Information”).

How do we collect your Personal Information?

Guud directly collects this Personal Information:

  • directly from you when provided to us;
  • automatically as you navigate through the Guud Platform or makes use of the Services, and
  • from third parties, for example, our business partners, only as it pertains to the provision of the Services.

Guud does not have access to your medical records and thus does not collect, store or share of any of your health information. 

Why do we collect your personal information?  

Your personal information will be collected essentially for the following reasons:

  • to identify you;
  • to request feedback from you;
  • to contact you if there is a grievance and assist in the resolution thereof;
  • to market products to you; 
  • estimate our user size and usage patterns;
  • develop and improve our products and services;
  • store information about your preferences, allowing us to customize the Guud Platform according to your individual interests or relevant information;
  • recognize you when you return to the Guud Platform;
  • to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • to notify you about changes to the Guud Platform, or any products or services we offer or provide though them; and
  • for any other purpose with your consent.

We may also use your Personal Information to contact you about goods and services that may be of interest to you, including through newsletters.

If you wish to opt-out of receiving such communications, you may do so at any time by clicking unsubscribe at the bottom of these communications.

How do we protect your personal information?

Security measures are implemented to maintain the safety of your Personal Information. Personal information on the Guud Platform is encrypted with SSL/TLS technology in transit.

Your Personal Information shall be treated as confidential and collected, processed, and stored by Guud in a manner that ensures appropriate security thereof, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical and organisational measures, which include:

•   identity and access management to software restricted to authorised individuals who  require it to perform the services to you;

  • infrastructure and operations security;

•   confidentiality agreements.  Employees and contractors who have access to Personal  Information are bound by confidentiality clauses in their respective agreements.

•   training and awareness; and

  • disaster recovery planning.  

We have put in place procedures to deal with any suspected data security breaches and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

The safety and security of your Personal Information also depends on you. Where you have chosen a password for the use of the Guud Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Disclosure of Personal Information

We will not disclose information that personally identifies you to any third party other than as set out in this Privacy Policy. In order to deliver the Services, we may disclose your Personal Information to other individuals or organisations but only in relation to providing the Services to you. 

  • Guud may share Personal Information with the following categories of third parties for the following purposes:
    • Service Providers: We may share your Personal Information with service providers, such as contractors and other third parties we use to support our organization and provide us with services. These companies are subject to contractual obligations governing privacy, data security, and confidentiality consistent with applicable laws. 
    • Corporate Affiliates: We may share your Personal Information with our subsidiaries, affiliates, and associated organizations;
    • Research Partners: We may share your Personal Information with research partners if you provide us with your express consent or if otherwise permitted by law. Research partners include commercial or non-profit organizations that conduct or support scientific research. In some circumstances, a research partner or Guud may have a financial interest in the research arrangement.
    • Health Care Providers, your Employer, Medical Aid Schemes, and Similar Organizations: Personal Information that we create or obtain about you may be shared with health care providers,  medical schemes, your employer, as permitted by law or pursuant to your consent.
    • Law Enforcement, Government Agencies or Other Third Parties: From time to time, we may be required to provide Personal Information to a third party in order to comply with a subpoena, court order, government investigation, or other similar legal process. If we disclose your Personal Information in this way, we will reasonably attempt to provide you with advance notice, unless we are prohibited from doing so.

We take reasonable steps to ensure that these individuals or organisations are bound by privacy obligations in relation to the protection of your Personal Information.  

We may also disclose your Personal Data if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Guud, our users, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We may also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregated data may be derived from your personal information, but is not considered personal information in law as this information does not, directly or indirectly, reveal your identity. However, if we combine or connect aggregated data with your personal information so that it can, directly or indirectly, identify you, we treat the combined data as personal information which will be used in accordance with this notice.

Transfers of Personal Information outside of South Africa

Personal Information that we collect from you may be transferred to, and stored at, a destination outside of South Africa. It may also be processed by staff operating outside South Africa who work for us or for one of our suppliers. Where we transfer your Personal Information outside South Africa, we will endeavor to ensure that there are adequate protections in place for your rights, in accordance with POPIA. By submitting your Personal Information, and in providing any Personal Information to us, you agree to this transfer, storing or processing.

Please note! Guud is not a medical group. All consultations with Healthcare Providers, (in-person or telehealth consultations) using the Guud Platform are provided by Healthcare Providers independent of Guud. If you do not agree to be bound by those terms, you are not authorized to make use of the Guud Platform and the Services.
